These Terms and Conditions (“Terms”) govern your use of the Tross Construction Inc. website and any quotes, estimates, contracts, or services provided by Tross Construction Inc. (Licence RBQ #5841923501) (“we,” “us,” “our,” or “the Company”). By accessing our website, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services

Tross Construction Inc. provides excavation, masonry, concrete, construction, interior and exterior renovation, waterproofing, drainage and pump systems, metal and wood work, custom cabinet fabrication, and security and communication systems installation, primarily serving Montreal, Quebec City, and surrounding areas. The specific scope of work for any project will be defined in a separate written contract or agreement between you and Tross Construction Inc.

2. Quotes and Estimates

• Quotes and estimates requested through our website or by phone/email are provided free of charge and are based on the information available at the time of the request.
• Quotes are estimates only and may be subject to change following an in-person site evaluation, changes in project scope, or unforeseen conditions (e.g., structural issues, permit requirements, material availability).
• Quotes are typically valid for a limited period, as stated on the individual quote document.
• A formal written contract will be provided prior to the commencement of any work, outlining final pricing, scope, timeline, and payment terms.

3. Payment Terms

• Payment terms, including deposits, progress payments, and final payment, will be specified in the project contract.
• Late payments may be subject to interest charges and/or suspension of work, as permitted by applicable law and as outlined in the project contract.
• All prices are in Canadian dollars unless otherwise stated and are subject to applicable taxes (GST/QST).

4. Licensing and Permits

Tross Construction Inc. holds a valid RBQ (Régie du bâtiment du Québec) licence #5841923501. Where required, we will assist in identifying necessary permits for a project; however, unless explicitly agreed otherwise in writing, obtaining and paying for permits, inspections, or municipal approvals is the responsibility of the client, and any related delays are outside our control.

5. Scheduling and Delays

We make reasonable efforts to complete projects within the estimated timeframe. However, timelines may be affected by weather, material availability, permit approvals, site conditions, or changes requested by the client. We are not liable for delays caused by factors beyond our reasonable control.

6. Changes to Scope of Work

Any changes to the agreed scope of work requested by the client after the contract is signed must be submitted in writing and may result in adjustments to price and/or timeline, to be agreed upon before the change is implemented.

7. Warranties

Workmanship is warranted in accordance with applicable Quebec construction law and the specific warranty terms provided in your project contract. Manufacturer warranties on materials and products supplied by third parties are passed through to the client as applicable and are subject to the manufacturer’s terms.

8. Limitation of Liability

To the extent permitted by law, Tross Construction Inc. shall not be liable for indirect, incidental, or consequential damages arising from the use of our website or the provision of our services, except in cases of gross negligence or willful misconduct. Nothing in these Terms limits liability that cannot be excluded under applicable Quebec or Canadian law.

9. Cancellations

Cancellation terms, including any applicable fees for work already performed, materials ordered, or deposits paid, will be set out in the individual project contract.

10. Website Use

• The content on this website (text, images, logos, and design) is the property of Tross Construction Inc. and may not be reproduced without our written permission.
• You agree not to use this website for any unlawful purpose or in any way that could damage, disable, or impair the site.
